EU court: bank must refund fraud victim without proof of her fault

The EU Court of Justice ruled that in cases of unauthorized payment transactions, the payment service provider must refund the customer. The only exception is justified suspicion that the customer committed the fraud themselves. Until now, banks refused refunds citing gross negligence by the consumer, who had to pursue their rights in court, explains legal advisor Wojciech Bochenek.
