EU court: judge may offset bank and borrower claims, awarding only the difference
The EU Court of Justice ruled Thursday that EU law does not in principle forbid courts from offsetting mutual claims between a bank and consumer after a franking-credit loan contract is voided, awarding only the difference between them. Polish courts will gain a new tool for resolving disputes with banks. The ruling has already drawn comment from the financial sector.
