CJEU rules franc case law does not automatically apply to euro-denominated loans
The Court of Justice of the EU has stressed that case law developed around Swiss franc mortgage disputes cannot be automatically applied to euro-denominated loans. Each case requires an independent assessment of the actual contractual balance between the parties. Polish lawmakers have explicitly excluded euro-loan agreements from the legal remedies introduced for franc borrowers.
