CJEU advocate general: Poland's mixed Supreme Court bench is not independent

CJEU Advocate General Tamara Ćapeta issued an opinion that the EU's top court should declare itself incompetent to rule on the composition of Poland's Supreme Court. Should the court nonetheless choose to issue a judgment, it would have to find that the mixed bench — combining judges appointed before and after the judicial reforms — does not meet the standard of an independent court.
