ECJ rules bank's claim for CHF loan capital repayment can start running from borrower's first challenge

The Court of Justice of the EU has ruled that the limitation period for a bank's claim to recover capital from a Swiss franc mortgage loan may begin on the date the borrower first challenged the contract's validity. The ECJ said this approach better balances the interests of both parties. The ruling has significant implications for thousands of ongoing Swiss franc loan cases in Poland.
