CJEU: Bank's claims against CHF borrowers expire from consumer's first objection
The Court of Justice of the EU ruled Thursday that the statute of limitations on a bank's claim for repayment of CHF loan capital may begin on the day the consumer first challenged the binding nature of the contract terms. The ruling covers Polish cases C-261/25 Ścierbek and C-262/25 Drózdzik. The decision is significant for thousands of Swiss-franc mortgage holders in ongoing disputes with Polish banks.
