EU regulates ChatGPT as a search engine but chat and advice features remain uncovered

The European Commission has designated ChatGPT as a Very Large Online Search Engine under the Digital Services Act, imposing transparency and risk-mitigation obligations on OpenAI similar to those applied to Google and Bing. OpenAI faces fines of up to 6% of its global annual revenue for non-compliance. However, the designation covers only ChatGPT's search functions — its use as a conversational assistant, therapist or adviser falls outside the new rules, a gap experts warn is significant.
