Inheritance claim on a gifted flat: how is the amount calculated in Poland?
Gifting a flat during one's lifetime does not shield the estate from inheritance claims after death in Poland. The claimable amount depends on current property prices, the flat's condition at the time of the gift, the number of heirs, and prior benefits received. Missing a single document can shift the final figure by tens of thousands of zlotys. As a rule, the claim equals half the heir's intestate share, or two-thirds for permanently disabled or minor heirs.
