Supreme Administrative Court: Accidentally entering someone's PESEL into ZUS system is highly implausible

Poland's Supreme Administrative Court stated that it is hard to consider it accidental when someone enters a specific person's PESEL number into the ZUS social insurance system. Under GDPR rules, the intentionality of a personal data breach and its subsequent use affect the penalty imposed. The court stressed that this requires evidentiary proceedings rather than simply accepting claims that a breach was accidental.
