CJEU: bank's claim limitation period starts when consumer first challenges the contract
EU law allows the limitation period for a bank's claim to recover repaid loan capital to begin only from the day a consumer first challenged the binding nature of the contract's terms. The ruling is particularly significant for Swiss franc mortgage borrowers and other consumer disputes with banks in Poland. Banks therefore cannot benefit from the fact that a consumer was unaware of unfair contract terms for a long time.
