Polish Supreme Administrative Court: a staffless holding company can be a genuine beneficial owner
Poland's Supreme Administrative Court (NSA) has ruled that a holding company does not need to employ many people or engage in production to qualify as the genuine beneficial owner of income for withholding tax purposes. The ruling may mark a turning point in case law and benefit foreign holding structures operating in Poland. It challenges the previous practice of tax authorities treating such entities as artificial constructs.
