Two Legnica court rulings, two methods for calculating transmission easements — thousands of zlotys apart
The District Court in Legnica issued two conflicting rulings on transmission easement strip widths just 17 days apart, using different calculation methods. One ruling considered only routine network operation, while the other also factored in rare events such as breakdowns occurring once every few decades. The discrepancy results in meaningfully different land areas burdened by easements and different compensation amounts for property owners. The lack of uniform case law creates significant legal uncertainty.
