CJEU: panel including neo-judge may lack independence
The Court of Justice of the European Union has ruled that irregularities in a judge's appointment can alone be sufficient to call into question the independence of the entire judicial panel. The court specified that this applies when the irregularities are serious enough to suggest that the executive branch may have influenced the appointment process — a ruling directly relevant to Poland's neo-judge controversy.
