Inheritance rights: when a child excluded from a will can claim a forced share

Polish law protects children excluded from a parent's will through the institution of a "zachowek" (forced share). A child passed over in a will or disadvantaged by earlier gifts can demand a specific cash payment — not an automatic share of property itself. The forced share equals half of the statutory inheritance share, or two-thirds for minors and permanently incapacitated heirs.
