Leaving a Will to a Granddaughter: Family Loses Inheritance but Keeps Statutory Share
Leaving an entire estate to a granddaughter via a will is legally valid and overrides the statutory order of inheritance, but it does not eliminate the right of other family members to a statutory share (zachowek). That share equals half — or two-thirds for minors and permanently incapacitated persons — of what they would have received under intestate succession. The granddaughter named as heir may therefore be required to pay out those claims from her own inherited assets.
